Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Hungr, operated by Elijah Tan ("hungr", "we", "us", or "our"). They govern your use of the hungr mobile app, website, and related services (the "Service"). Please also read our Privacy Policy, which explains how we handle your information.
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old to use hungr. By using the Service, you confirm that you are 16 or older and able to enter into these Terms. The Service is not intended for children under 16.
2. Your account
You are responsible for the activity on your account and for keeping your login method secure. Tell us promptly at elijahtanshian@gmail.com if you suspect unauthorized access. You may delete your account at any time in the app (Settings, then Delete account). A deletion request immediately hides your account and begins a 30-day restore period. After that period, we permanently delete the account and associated first-party data, including content you shared with other users, subject only to the limited retention described in our Privacy Policy.
3. The Service
hungr helps you discover food using a map, search, saved places, reviews, photos, and friend and community activity. Some place information (names, locations, ratings, review snippets, photos, and AI-grounded answers) comes live from Google Maps, Google Places, and Google's grounding tools and belongs to Google or its sources. That third-party content may be incomplete, out of date, or inaccurate, and we do not control or guarantee it. hungr's own community content is separate and is based on first-party data contributed by users.
We may change, suspend, or discontinue any part of the Service at any time.
4. Your content
"Your content" means anything you submit to the Service, such as reviews, comments, ratings, notes, photos, captions, tags, and profile information. You keep any copyright and other ownership rights you hold in your content.
When you make content public or share it with an audience through hungr, you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, format, crop, resize, caption, excerpt, publish, display, distribute, and otherwise use that content to operate, secure, improve, market, advertise, and promote hungr. This licence permits Hungr-branded website, social, app-store, public-relations, and paid advertising materials without separate approval or payment. It also permits our contracted service providers to process selected content only to create, host, deliver, or measure those Hungr campaigns. We will not materially misrepresent the meaning of your content or imply an endorsement you did not make.
This promotional licence does not apply to private notes or messages, authentication or contact details, precise location, support communications, private event information, dietary or provenance fields that are not public, or other confidential information merely because we hold it. We do not sell your content or license it to unrelated third parties for their independent advertising.
If you delete content or permanently delete your account, we will stop selecting that content for new promotional uses and remove it from future digital campaigns within a reasonable operational period. We are not required to recall printed material or other advertising already produced, distributed, or contractually committed before deletion. Temporary production files, short-lived backups, legal records, and de-identified or aggregated information may remain as described in our Privacy Policy. The licence survives only to the extent reasonably necessary for those existing materials, records, and wind-down obligations.
You are responsible for your content and confirm you have the rights to submit it and that it does not infringe anyone else's rights or break the law.
5. Acceptable use and community rules
hungr has zero tolerance for objectionable content or abusive behavior. You agree not to submit, post, or share content, or behave in a way, that:
- is unlawful, defamatory, harassing, threatening, hateful, or discriminatory;
- is pornographic, obscene, violent, or otherwise objectionable;
- impersonates another person or misrepresents your affiliation;
- is spam, a scam, fake, or manipulates ratings or reviews;
- infringes intellectual property, privacy, or other rights;
- contains malware, or attempts to hack, scrape, overload, or reverse engineer the Service;
- harasses, bullies, stalks, or endangers another person.
You must not misuse Google content in violation of Google's terms, and you must not use the Service to build a competing dataset by scraping.
Reporting and blocking. You can report objectionable reviews, photos, and bugs from within the app, and you can block another user from their profile so you no longer see each other's content and neither of you can contact the other. We review reports and act on objectionable content and abusive users, typically within 24 hours, by removing content, blocking users, or terminating accounts.
6. Moderation and enforcement
We may remove content, limit features, or suspend or terminate accounts that violate these Terms or that we reasonably believe are harmful, at our discretion. We are not obligated to host any content.
7. Intellectual property
The Service, including its software, design, branding, and our own content, is owned by us or our licensors and is protected by law. We grant you a limited, personal, non-transferable, revocable licence to use the Service under these Terms. You may not copy, modify, distribute, sell, or create derivative works from the Service except as expressly allowed.
Information, images, screenshots, branded share assets, compilations, exports, rankings, or data presentations copied or republished from hungr must clearly identify hungr as the source, for example with Source: hungr or via hungr. Where the underlying content identifies a user creator, you must also retain the displayed creator name or handle where reasonably practicable. You may not remove Hungr branding or source attribution supplied with an export or share asset. Required Google or other third-party provider attribution must also remain intact, and third-party content must not be presented as Hungr community content.
This attribution requirement does not prevent you from independently using your own original writing or image outside hungr without attributing hungr.
8. Third-party services
The Service relies on third parties, including Google (Maps, Places, and grounding), Apple, and Supabase. Your use of their features may be subject to their own terms and privacy policies. We are not responsible for third-party services or content.
If you ask us to process a public TikTok or Instagram link to help find a place, you confirm that you have the right to submit that link. We process the public link only to provide the requested save or place-matching feature, as described in our Privacy Policy. We do not download the source video.
9. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that place information, recommendations, ratings, or availability are accurate, complete, or current, or that the Service will be uninterrupted or error-free. Decisions you make based on the Service, such as where to eat, are your own.
Nothing in these Terms excludes rights or guarantees that cannot be excluded under the Australian Consumer Law or other laws that apply to you.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Where liability cannot be excluded but can be limited, our total liability is limited to the greater of the amount you paid us in the 12 months before the claim, or AUD 100.
11. Indemnity
You agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your breach of these Terms, to the extent permitted by law.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service or other users. Sections that by their nature should survive termination (including content licence for already-shared content, intellectual property, disclaimers, limitation of liability, and indemnity) survive.
13. Changes to these Terms
We may update these Terms from time to time. If changes are material, we will provide notice through the app, website, or email. Changes take effect when posted unless stated otherwise. Continuing to use the Service after changes means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of New South Wales, without limiting any mandatory consumer protections that apply where you live.
